If you suddenly receive a cease-and-desist letter from a law firm saying, "We will sue you for copyright infringement," should you immediately pay the settlement fee?

Cases are skyrocketing where a single photo found on Google or a font casually used on a blog turns into a bill for thousands of dollars. So-called "Copyright Trolls"—those who run a "settlement business"—feed on your fear. In one actual case, a small business was forced to the brink of closing down after being hit with a $4,000 settlement demand over a tiny icon used on their website.

But don't panic. The settlement they demand isn't always justified.

If there was no intent, if the image used has low copyright value, or if the other party is demanding an excessive amount, there is plenty of room to fight back legally. Paying the money blindly can be seen as admitting to a crime. Copyright law is meant to protect creators, not to be used as a tool to blackmail businesses for money.

If you’ve received an unfair legal notice, collect your evidence, seek professional advice, and stand your ground. The first step in protecting your business is having the courage not to surrender to unjust demands.
